 Towing Help Hotline Emergency Services Terms of Use

These Terms and Conditions outline the rules for using Towing Help Hotline's emergency services, including online requests and phone-based dispatch. The services are owned and operated by Towing Help Hotline.

1. General Terms

Towing Help Hotline is a 24/7 dispatch and towing network that provides rapid, non-consensual (upon request), and emergency vehicle recovery and transport. To access and use the services, you must agree to these Terms.

2. Service Access and Scope

2.1 Service Request and Acceptance

To access the Towing Help Hotline Service, you must provide accurate information about your location, vehicle, and service needs. By using the Service, you acknowledge and agree to the following:

Vehicle Access: You authorize the dispatched tow operator to access and tow your vehicle from the specified location.
Location Data: Any location information provided may be transmitted over various unencrypted networks to facilitate dispatch.
Liability: You agree that the Service begins when you request a tow and ends upon successful delivery to the drop-off location or when the service is cancelled.

2.2 Prohibited Uses

You understand and agree that you may not:

Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Towing Help Hotline dispatch platform or website content without express written permission.
Verbally, physically, or otherwise abuse any Towing Help Hotline employee or dispatched tow operator.
Transmit worms, viruses, or any code of a destructive nature via our service request forms or communications.
Request service for a vehicle that is not legally yours or that you do not have permission to authorize for tow.
Violate any applicable federal, state, or local laws or regulations during your interaction with the Service or the tow operator.

3. Warranties and Limitation of Liability

Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis. Towing Help Hotline does not warrant that the dispatch Service will be uninterrupted, timely, secure, or error-free.

4. Fees and Payments

You shall pay any fees or charges to your account in accordance with the billing terms provided to you at the time of the tow request. Payment is required in advance before the tow is completed. All payment obligations are non-cancelable and non-refundable once the tow truck arrives at the pick-up location.

5. Privacy

Your data and other information are subject to the Towing Help Hotline Privacy Policy, available on our website. If you are located outside the United States, by using the Service you consent to your data being sent to the United States and transmitted, stored, and utilized pursuant to United States law.

6. Indemnification

You agree to defend, indemnify, and hold harmless Towing Help Hotline, its employees, officers, directors, and agents against all claims, expenses, liabilities, losses, costs, and damages that the company may incur in connection with:

Your request or use of the Service;
A violation of any of your representations, warranties, or obligations under this Agreement;
* Your violation of any rights of another.

7. Miscellaneous Provisions

This Agreement shall be governed by and construed under the laws of South Carolina. Any dispute arising hereunder will be settled through third-party mediation in Lexington County, South Carolina. You acknowledge and agree that you and Towing Help Hotline are independent contractors.
